Controversial cross-dresser Idris Okuneye, popularly known as Bobrisky, has taken legal action to challenge the six-month maximum sentence handed down to him by a Federal High Court in Lagos State.
Bobrisky was charged by the Economic and Financial Crimes Commission (EFCC) on four counts related to naira abuse and pleaded guilty before Justice A.O. Awogboro of the Federal High Court, Lagos.
On April 12, Justice Awogboro sentenced Bobrisky to six months imprisonment without the option of fine, emphasizing that the judgment should deter others from abusing and mutilating the naira.
In response, Bobrisky’s counsel, Mr. Bimbo Kusanu, filed a notice of appeal urging the Court of Appeal to overturn the maximum sentence. Kusanu requested that the court replace the sentence with an option of a N50,000 fine for each count.
In the notice of appeal, Kusanu argued that the trial court imposed the maximum sentence on Bobrisky, who had no prior criminal record, and failed to consider the provisions of the Administration of Criminal Justice Act (ACJA) which allow for lesser sentences.
He contended that Bobrisky’s positive antecedents, including his prompt appearance in court and cooperation with the EFCC, were not taken into account during sentencing. Kusanu asserted that the trial court’s decision resulted in a miscarriage of justice against Bobrisky.
